The Services are offered through our websites, including kylerfisher.com, fisherperformancelab.com, and fracturedtofounder.com, and may include products marketed under the brand name "The Practical Manifestor."

By accessing our websites, purchasing a product, or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

2. Eligibility

You must be at least 18 years of age to purchase products or use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

3. Company Information

The Services are operated by:

GOODBOY LLC DBA Fisher Performance Lab Attn: Kyler Fisher 2236 SE 100th Lane, Suite 3904 Webster, FL 33597 United States

4. Products and Services

Fisher Performance Lab offers digital products, including downloadable guides, protocols, audio programs, and related educational and performance materials. All products are delivered electronically unless otherwise stated.

We reserve the right to modify, discontinue, or update any product or service at any time without notice. Product descriptions, pricing, and availability are subject to change.

5. Not Medical, Psychological, or Professional Advice

This is important. Please read carefully.

The products, content, and Services offered by Fisher Performance Lab are for educational and informational purposes only. They are not a substitute for professional medical, psychological, psychiatric, therapeutic, or financial advice, diagnosis, or treatment.

Fisher Performance Lab is not a healthcare provider, and nothing in our Services constitutes the practice of medicine, psychotherapy, counseling, or any other licensed professional service. The techniques, protocols, and information provided are not intended to diagnose, treat, cure, or prevent any disease, mental health condition, or physical condition.

Always seek the advice of a qualified physician, mental health professional, or other licensed provider with any questions you may have regarding a medical or psychological condition. Never disregard professional advice or delay seeking it because of something you have read or accessed through our Services.

You should consult a qualified healthcare professional before beginning any new performance, somatic, breathing, relaxation, or nervous-system practice, particularly if you have any pre-existing physical or mental health condition.

6. No Guarantee of Results

Fisher Performance Lab makes no guarantee, representation, or warranty regarding specific outcomes or results from the use of our products or Services. Individual results vary based on numerous factors outside our control, including effort, consistency, individual circumstances, and other variables.

Any examples, testimonials, case studies, or references to results achieved by other individuals are not a promise or guarantee that you will achieve similar results. References to use of similar modalities by public figures, professionals, or organizations are provided for informational and contextual purposes only and do not constitute an endorsement of our products.

7. Assumption of Risk and Release of Liability

You voluntarily choose to use our products and Services and assume all risks associated with that use. By using the Services, you acknowledge that you are responsible for your own physical and mental wellbeing.

To the fullest extent permitted by law, you release and hold harmless GOODBOY LLC, Fisher Performance Lab, and their owners, officers, employees, and contractors from any and all claims, liabilities, damages, or expenses arising out of or related to your use of the products or Services.

8. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Payment is due at the time of purchase. We use third-party payment processors, and by submitting payment information, you agree to the terms of those processors. We are not responsible for errors or issues caused by third-party payment processors.

We reserve the right to correct pricing errors and to refuse or cancel any order placed at an incorrect price.

9. Future Subscription and Recurring Billing Products

Certain products may, in the future, be offered on a subscription or recurring-billing basis. If you purchase a subscription product, the following terms will apply:

You authorize us and our payment processors to charge the applicable fee to your payment method on a recurring basis (e.g., monthly or annually) until you cancel. Subscriptions automatically renew at the end of each billing cycle at the then-current price unless you cancel before the renewal date. You may cancel a subscription at any time by following the cancellation instructions provided with the product or by contacting us at [email protected]. Cancellation stops future charges but does not retroactively refund amounts already billed, except as required by law or as expressly stated in the applicable offer.

Specific subscription pricing, billing intervals, and cancellation procedures will be disclosed at the point of sale for any such product.

10. Refund Policy — 30-Day Money-Back Guarantee

We offer a 30-Day Money-Back Guarantee on eligible digital products. Because our products are digital and delivered immediately, the following terms apply to all refund requests.

To be eligible for a refund, you must submit your request within thirty (30) days of the original purchase date. A refund request will only be considered if it is accompanied by supporting documentation demonstrating that you have genuinely applied the product as instructed. This documentation typically consists of screenshots, photographs, or other written evidence showing that you completed the exercises, protocols, worksheets, or practices contained in the product.

This requirement exists because our guarantee is intended for customers who have made a good-faith effort to use the material and found it did not work for them — not as a means to obtain the product for free. We reserve the sole discretion to determine whether the documentation submitted is sufficient to demonstrate good-faith use.

Refund requests that are submitted after the 30-day window, that lack adequate supporting documentation, or that we determine in good faith to be fraudulent or abusive may be denied. Approved refunds will be issued to the original payment method within a reasonable period. We reserve the right to revoke your license to and access to any product for which a refund is issued.

To request a refund, contact us at [email protected] with your order details and supporting documentation.

11. License and Permitted Use

Upon purchase, Fisher Performance Lab grants you a limited, non-exclusive, non-transferable, revocable license to access and use the purchased digital product for your own personal, non-commercial use.

You may not, without our express written permission: resell, redistribute, share, sublicense, or publicly post the products; reproduce or copy the products except for your own personal use; use the products to create derivative or competing works; or remove any copyright, trademark, or proprietary notices.

Violation of this license terminates your right to use the product and may result in legal action.

12. Intellectual Property

All content, materials, products, branding, logos, text, graphics, design systems, protocols, and other intellectual property made available through the Services are owned by GOODBOY LLC / Fisher Performance Lab or its licensors and are protected by United States and international intellectual

property laws. This includes content marketed under the "Fisher Performance Lab" and "The Practical Manifestor" brand names.

Nothing in these Terms transfers ownership of any intellectual property to you.

13. User Conduct

You agree not to use the Services in any way that is unlawful, fraudulent, or harmful, or that infringes the rights of others. You agree not to attempt to gain unauthorized access to our systems, interfere with the operation of the Services, or use automated means to access or scrape the Services without permission.

14. Affiliate Program

We may, from time to time, offer an affiliate or referral program that allows participants to earn commissions for promoting our products. Participation in any such program is subject to separate affiliate terms, which will be provided to participants and which form a binding agreement in addition to these Terms. We reserve the right to establish, modify, suspend, or discontinue any affiliate program, and to determine commission structures, payment terms, and eligibility, at our sole discretion. Affiliates must comply with all applicable laws, including truth-in-advertising and disclosure requirements, and may not make false, misleading, or unauthorized claims about our products.

15. Third-Party Links and Services

The Services may contain links to third-party websites, products, or services. We are not responsible for the content, accuracy, or practices of any third party. Your use of third-party services is at your own risk and subject to their terms.

16. Disclaimer of Warranties

The Services and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

17. Limitation of Liability

To the fullest extent permitted by law, in no event shall GOODBOY LLC, Fisher Performance Lab, or their owners, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to the Services shall not exceed the amount you paid to us for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

18. Indemnification

You agree to indemnify, defend, and hold harmless GOODBOY LLC, Fisher Performance Lab, and their owners, officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

19. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms.

20. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.

Binding Arbitration. Except for disputes that qualify for small claims court, you and Fisher Performance Lab agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules. The arbitration shall be conducted in Sumter County, Florida, or another mutually agreed location, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. You and Fisher Performance Lab agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

Forum for Non-Arbitrable Disputes. To the extent any dispute is not subject to arbitration, you agree that it shall be brought exclusively in the state or federal courts located in Sumter County, Florida, and you consent to the personal jurisdiction of those courts.

If any portion of this Section 20 is found to be unenforceable, the remainder shall remain in effect, except that if the Class Action Waiver is found unenforceable, the entire arbitration agreement in this Section shall be null and void.

21. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

22. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and Fisher Performance Lab regarding the Services.
